SUBJECT: Street Acceptance - Kendall Creek Court located in Section Two, Kendall Creek

INITIATED BY: Engineering Department


Recommendation: Approval is requested for the acceptance of Kendall Creek Court located in Section Two, Kendall Creek.

Background: Kendall Creek Court located in Section Two, Kendall Creek has (9) Nine residential lots. The street has been improved and meets the required specifications for acceptance by the City.

Analysis: A deed has been conveyed to the City conveying Kendall Creek Court located in Section Two, Kendall Creek. A description of property is as follows: All that lot, tract or parcel of land situate, lying and being in Columbus, Muscogee County, Georgia, designated as "Kendall Creek Court", as shown upon a map or plat entitled "Phase Two Kendall Creek, Part of Land Lots 225, 226, 255 & 256, 17th District, Columbus, Muscogee County, Georgia, prepared by Moon, Meeks, Mason & Vinson dated December 20, 2017, and recorded in Plat Book 165, Page 233, in the Office of the Clerk of Superior Court of Muscogee County, Georgia.

Financial Considerations: No City funds are involved until maintenance is assumed after the two-year warranty.

Projected Annual Fiscal Impact Statement: No City funds are involved until maintenance is assumed after the two-year warranty.

Legal Considerations: In accordance with Section 18-3 of the Columbus Code, all dedicated right-of-way must be accepted by Council.

Recommendations/Actions: Approval is requested for the acceptance of Kendall Creek Court located in Section Two, Kendall Creek.

A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A DEED TO KENDALL CREEK COURT LOCATED IN SECTION TWO, KENDALL CREEK ON BEHALF OF COLUMBUS, GEORGIA.

WHEREAS, Columbus, Georgia has been submitted a deed conveying Kendall Creek Court located in Section Two, Kendall Creek, a full description of property on said deed; and,

WHEREAS, said street has been improved and meets the required specifications for acceptance by the City; and,

WHEREAS, the Engineering Department has inspected said streets and recommends acceptance of same.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That certain deed dated February 19, 2018 conveying to Columbus, Georgia Kendall Creek Court located in Section Two, Kendall Creek be and the same is hereby accepted. The Clerk of Council is hereby authorized to have said deed recorded in the Deed Records in the Office of the Clerk of Superior Court of Muscogee County, Georgia. A copy of deed is hereto attached and by this reference made a part of this resolution.
