Planning Area D
Land Use Designation:
|Environmental Impacts:||The property does not lie within the floodway and floodplain area. The developer will need an approved drainage plan prior to issuance of a Site Development permit, if a permit is required.|
|City Services:||Property is served by all city services.|
|Traffic Impact:||This rezoning request does not anticipate generating a negative impact on the transportation network. |
|Surrounding Zoning:||North – GC (General Commercial)|
South – SFR4 (Single Family Residential 4)
East – RMF1 (Residential Multifamily 1)
West – RMF1 (Residential Multifamily 1)
|Reasonableness of Request||The request is consistent with the future land-use map of the 2028 Comprehensive Plan.|
|Buffer Requirements||The site shall include a Category C buffer along all property lines bordered by the RMF1 and SFR4 zoning districts. The 3 options under Category C are: |
1) 20 feet with a certain amount of canopy trees, under story trees, and shrubs / ornamental grasses per 100 linear feet.
2) 10 feet with a certain amount of shrubs / ornamental grasses per 100 linear feet and a wood fence or masonry wall.
3) 30 feet undisturbed natural buffer.
|Attitude of Property Owners:||Forty-nine (49) property owners within 300 feet of the subject properties were notified of the rezoning request. The Planning Department received two calls in opposition and one call inquiring about the rezoning.|
|Additional Information:||The purpose of this rezoning request is to bring the existing site into conforming status. The existing convenience store with gas sales is a legal nonconforming use. The existing business has been there for 30+ years. RMF1 is a residential zoning and does not allow any commercial activity. |
An existing legal nonconforming use prevents the business owner from refinancing or borrowing against the business; it prevents the property owner from replacing the existing store/pumps with a new store/pumps; and it prevents the business owner from rebuilding if the business is destroyed by a natural disaster.
