SUBJECT: Street Acceptance - That portion of Massee Lane located in Old Town Development - Phase One

INITIATED BY: Engineering Department

Recommendation: Approve the acceptance of that portion of Massee Lane located in Old Town Development Phase One.

Background: That portion of Massee Lane located in Old Town Development Section One is a Planned Unit Development (PUD). The street has been improved and meets the required specifications for acceptance by the City.

Analysis: A deed has been conveyed to the City conveying that portion of Massee Lane located in Old Town Development Phase One. A description of property is as follows: All those tracts and parcels of land situate, lying and being in the State of Georgia, County of Muscogee and City of Columbus, in Land Lot 269, 19th District, Muscogee County, Georgia identified as "Massee Lane" on the Plat titled "Phase One Old Town Part of Land Lot 40, 8th District and Land Lots 263, 269, 270 and 294, 19th Land District Columbus, Muscogee County, Georgia November 14, 2013" by Farner Barley and Associates, recorded in Plat Book 164, Page 56, Muscogee County, Georgia Records.

Financial Considerations: No City funds are involved until maintenance is assumed after the two-year warranty.

Projected Annual Fiscal Impact Statement: No City funds are involved until maintenance is assumed after the two-year warranty.

Legal Considerations: In Accordance with Section 18-3 of the Columbus Code, all dedicated right-of-way must be accepted by Council.

Recommendations/ Actions: Approve the Resolution accepting a deed to that portion of Massee Lane located in Old Town Development Phase One.

A RESOLUTION

NO. _____

A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A DEED TO THAT PORTION OF MASSEE LANE LOCATED IN PHASE ONE OLD TOWN ON BEHALF OF COLUMBUS, GEORGIA.

WHEREAS,

Columbus, Georgia has been submitted a deed conveying that portion of Massee Lane located in Phase One Old Town, a full description of property on said deed; and,

WHEREAS, said street has been improved and meets the required specifications for acceptance by the City; and,

WHEREAS, the Engineering Department has inspected said street and recommends acceptance of same.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

That certain deed dated December 2, 2013, conveying Columbus, Georgia, that portion of Massee Lane located in Phase One Old Town be and the same is hereby accepted. The Clerk of Council is hereby authorized to have said deed recorded in the Deed Records in the Office of the Superior Court of Muscogee County, Georgia. A copy of the deed is hereto attached and by this reference made a part of this resolution.
