A RESOLUTION TO REGULATE AND TO PROVIDE FOR THE CALLING OF AN ELECTION TO DETERMINE THE EXERCISE OR NON-EXERCISE OF REDEVELOPMENT POWERS BY COLUMBUS, GEORGIA UNDER CHAPTER 44 OF TITLE 36 OF THE OFFICIAL CODE OF GEORGIA ANNOTATED, THE “GEORGIA REDEVELOPMENT POWERS LAW,” AS AMENDED, IN ACCORDANCE WITH 2013 GEORGIA LAWS, PAGE 3670 (HOUSE BILL NO. 414); TO RESCIND CONFLICTING RESOLUTIONS; AND FOR OTHER PURPOSES.
WHEREAS, the Mayor and Columbus Council are the governing authority of Columbus, Georgia; and
WHEREAS, the Mayor and Columbus Council desire to promote economic redevelopment within Columbus, Georgia; and
WHEREAS, the Mayor and Columbus Council seek new economic development incentives that may be used to stimulate redevelopment of distressed and underdeveloped areas of Columbus, Georgia; and
WHEREAS, the Mayor and Columbus Council have concluded that the Redevelopment Powers Law offers the most powerful and effective tools for stimulating redevelopment under Georgia law; and
WHEREAS, H.B. 414 authorizes the governing authority of Columbus, Georgia to exercise all powers under the Georgia Redevelopment Powers Law contingent upon the calling of a referendum and a majority of the voters of Columbus, Georgia approving the exercise of powers under the Redevelopment Powers Law;
WHEREAS, Pursuant to H.B. 414, the Columbus Council has determined that said referendum should be held on November 4, 2014.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES:
1. There is hereby authorized to be called and the Muscogee County Board of Elections and Registration shall call for an election to be held in all the precincts in Columbus and Muscogee County, Georgia in conjunction with the General Election on November 4, 2014 for the purpose of submitting to the qualified voters of the consolidated government of Columbus, Georgia the question of whether or not to authorize the consolidated government of Columbus, Georgia to exercise redevelopment powers as fully as the “Redevelopment Powers Law” may now or hereafter permit, and not to limit any redevelopment powers permitted under the “Redevelopment Powers Law.”
2. The Executive Director of the Muscogee County Board of Elections and Registration shall cause the date and purpose of the election to be published once a week for two weeks immediately preceding the date thereof in the official organ of consolidated government of Columbus, Georgia. The ballot shall have written or printed thereon the words:
“( ) YES Shall the Act be approved which authorizes the consolidated government of Columbus, Georgia, to exercise redevelopment powers under the ‘Redevelopment
( ) NO Powers Law,’ as it may be amended from time to time?”
3. All Resolutions and parts of Resolutions in conflict with this Resolution are hereby rescinded and repealed.
