An Ordinance providing a 120-day moratorium on the issuance of permits under Article 8 of Chapter 8 of the Unified Development Ordinance repair, installation and construction which involves
small cell technology
in city rights-of-way and that said moratorium shall expire at midnight on Wednesday, November 23, 2016; and for other purposes.
THE COUNCIL OF COLUMBUS, GEORGIA HEREBY ORDAINS:
SECTION 1.
There is hereby enacted a 120-day moratorium on the issuance of any permit required under Article 8 of Chapter 8 of the Unified Development Ordinance to repair, install or construct small cell technology, including but not limited to, Femto cells, Pico cells, Micro-cells and Metro cells having a range of 30 feet to 400 feet, in the city right-of-way. This 120-day moratorium will expire at midnight on Wednesday, November 23, 2016.
SECTION 2.
The purpose of this moratorium is to allow an amendment to the Uniform Development Ordinance so that necessary specifics pertaining to small cell technology may be addressed appropriately and to assure that permitted local regulations are consistent with pending proposed DOT regulations as required by O.C.G.A.§ 32-4-92(10). The Planning Department is hereby directed during this time period to prepare an ordinance to govern this technology and to hold any necessary public hearings on this matter. This moratorium shall in no way prevent a telephone company from making a general application for right of way use pursuant to O.C.G.A. 46-5-1.
SECTION 3.
All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.
