An Ordinance amending the Zoning Atlas of the Consolidated Government of Columbus, Georgia; this amendment changes certain boundaries of a district located at
4732, 4740 & 4744 Kolb Avenue
(Residential Multi-Family) and
(General Commercial) Zoning District to
(Single Family Residential 4) Zoning District.
THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:
That the Zoning Atlas on file with the Planning Department is hereby amended by changing the aforementioned property from RMF1 (Residential Multi-Family) and GC (General Commercial) Zoning District to SFR4 (Single Family Residential 4) Zoning District:
4732 Kolb Avenue
All of those lots, tracts or parcels of land situate, lying and being in Columbus, Muscogee County, Georgia, known and designated at ALL OF LOTS NUMBERED SEVENTEEN (17) and EIGHTEEN (18) in BLOCK NUMBERED SIX (6), in that subdivision of land known at Hamilton Heights as said Lots 17 and 18 appear upon a map or plat of Hamilton Heights, as recorded in Deed Book ZZ Folio 57 (redrawn and recorded in Plat Book 18 Folio 21) in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, to which plat reference is made hereby for the particular location and dimensions of said Lots 17 and 18.
The said Lot 17 is the identical property described in Deed Book 597 Folio 83; Lot 18 is the identical property described in Deed Book 279 Folio 183 and Deed Book 243 Folio 383, all in the aforesaid Clerk's Office. Each of the herein described lots front 50 feet on the east side of Kolb Avenue and run squarely back a depth of 140 feet to an alley in the rear.
Being the identical property conveyed Alice King Binns by Paul E. Havnaer by Warranty Deed dated June 18, 1982
and recorded in said Clerk's Office in Deed Book 2112 Page 1.
Said property being that conveyed by Alice K. Binns (also known as Mrs. Alice K. Binns and Alice King Binns) to the Binns Family Limited Partnership (now known as the Binns Family Limited Liability Limited Partnership) pursuant to Warranty Deed dated June 30, 1998, and recorded at Book 4992 Page 44, Muscogee County Records.
Said property is identified as 4732 Kolb Avenue, Columbus
Georgia according to the present system of numbering houses in Columbus, Muscogee County, Georgia.

All those lots, tracts, and parcels of land situate, lying and being in Land Lot 67 and 74 of the 8th Land District of Columbus, Muscogee County, Georgia, and denominated as Lot 16 (0.161 acre) on map or plat entitled "SURVEY AND REPLAT FOR JOHN F. KRYSAK, LOT 16 & REPLAT OF LOTS 34,35 & 36, BLOCK "6," HAMILTON HEIGHTS," which map or plat was prepared by Faircloth & Associates, and is duly recorded in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, in Plat Book 135, Folio 26, being incorporated by reference herein, and to which map or plat reference should be made for the exact metes and bounds descriptions of said Lot 16 herein conveyed.
The property above described is hereby conveyed subject to all valid and enforceable restrictive covenants of record applicable thereto; and subject, also, to all valid and enforceable zoning ordinances and regulations applicable thereto so long as said ordinances and regulations remain in force and effect.
This conveyance is made subject to the covenants, restrictions, reservations and easements which are made and declared to be covenants running with the land which is recorded in that certain Warranty Deed recorded in Deed Book 5355, Page 4, aforesaid Clerk's Office.

All that Lot, tract and parcel of land situate, lying and being in Muscogee County, Georgia, being known and designated as ALL OF LOT NUMBERED FIFTEEN (l5), BLOCK NUMBERED "6", HAMILTON HEIGHTS, as said lot is shown upon a map or plat of said Subdivision recorded in Deed Book ZZ, page 57, in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, to which reference is made for a more specific location and dimensions of said lot.
Introduced at a regular meeting of the Council of Columbus, Georgia held on the 14
day of April, 2015; introduced a second time at a regular meeting of said Council held on the
, 2015 and adopted at said meeting by the affirmative vote of _______ members of said Council.
