Background: In June 2018, the City received a 2017 Intent to Issue FIFA Notice from the Tax Commissioners office for the properties located at 2362 South Andrews Road (Parcel #041 012 008) and 0 Cusseta Road (Parcel #041 006 012). After conducting research, we discovered the properties were quit claimed to the City by Milton M. Woodruff without the City’s knowledge or consent. Jacob Beil rendered a legal opinion to the matter and determined if the City does not wish to keep the property we would need to renounce the quit claim re-convey the property back to the original owner. The City does not have a need for this property and would like Council’s approval to renounce the transfer and quit claim the properties back to Mr. Woodruff.
Analysis: The properties were quit claimed to the City without knowledge or consent. These properties do not serve a purpose and is not needed for any future developments. With the City owning the properties, it increases liabilities, maintenance costs, and takes additional properties off of the tax roll.
Financial Considerations: Clarifying that title to the properties remains in the original owner will save the City potential maintenance costs, liability claims, and allow the property to remain on the tax rolls.
Legal Considerations: Council must approve all matters related to real estate.
Recommendations: Approval is requested to renounce, disclaim and quit claim the properties located at 2362 South Andrews Road (Parcel #041 012 008) and 0 Cusseta Road (Parcel #041 006 012) back to the original owner.
